Event Registration Terms and Conditions

By registering, the ensemble or organization ( the “Entrant”) acknowledges receipt, review, and acceptance of the following Terms and Conditions as well as the Event Registration Payment Terms and agree to the following when participating at all American Drum Line Association (ADLA) events.  Entrant further understands that a violation of these rules, regulations, policies or procedures could result in penalties or disqualification from an event and/or the season without refund.

Entrant accepts full liability for any act or omission by entire ensemble, performing members, students, staff, directors. instructors. designers, support personnel, student helpers, parents/legal guardians, guests of ensemble/entrant, volunteers or anyone else representing the entrant/ensemble or entrants/ensembles organization resulting in claims or damages at event sites, and further, that entrant will hold harmless American Drum Line Association (ADLA) its directors, officers, agents and employees from such claim or claims.

Rules and Regulations.  The “Rules, Policies, Procedures, Guidelines and Information” and any ”Rulebooks” are hereby incorporated into these Terms and Conditions by reference.   Entrant agrees it has read and will comply with the rules, policies, procedures, guidelines or any other regulations in the “Rules, Policies, Procedures, Guidelines and Information” and any “Rulebooks” for ADLA events.

The “Rules, Policies, Procedures, Guidelines and Information” are available on the website.

Insurance Requirements.  ALL “Independent” Ensembles and organizations must provide proof of minimum general liability coverage and proof of accident medical coverage by February 1st of each year and as specified in the Ensemble and Performer Eligibility.

Enrollment/Eligibility Verification.  All ensembles will be required to provide proof of performer age, proof of enrollment, and eligibility.  Click here for more information.

Event Registration Payment TermsEvent Registration, Fees, Changes, Payments, Cancellations, Transfers, Drops, No Shows.

Video/Photo Policy. THE USE OF AUDIO OR VIDEO RECORDING DEVICES IS STRICTLY PROHIBITED per terms of admission as an eyewitness to live performances. Violations could result in significant fines, penalties, and/or disqualification without refund at the sole discretion of the ADLA directors.

Any video or audio recording of performances at ADLA events is strictly prohibited.

As a reminder, any video recordings you posses of your ensembles performance should not be distributed, sold, posted to the Internet, video sharing sites, or any website for public viewing. This is in place to comply with United States copyright law and is strictly enforced.

Violation of these policies can result in penalties against your ensemble, up to disqualification. Please inform and monitor your staff, designers, performers, parents, staff and volunteers.

Additionally, for the safety of the performers, flash photography is not allowed.

Copyright/Permission to Use.  All Entrants, ensembles, and organizations are required to comply with all copyright laws. Entrant specifically agree and warrants that performance and/or use of arrangements of music, visual images and other materials, as well as the use of copyrighted audio, spoken text and display of copyrighted words and images comply with all applicable laws, rules, and regulations.

Entrant is responsible for any and all fees associated with permission to use and/or arrange copyrighted material.

Entrant understands and agrees that copying, public display or any other use of audio and video recordings of event performances is strictly prohibited, is against the law, and could result in significant monetary fines and penalties.

It is the ensemble’s responsibility to obtain all necessary arranging and performance permissions and licenses for any copyrighted materials used in your performance or pre-show.  Not obtaining these permissions could result in yourself, your arranger, your ensemble and/or school or school district being held liable by the copyright holder.

Copyright violations could result in penalties or disqualification from an event and/or the season without refund at the sole discretion of the ADLA directors.

Likeness/Consent for use of photographic or video images.  Entrant consents that American Drum Line Association (ADLA) or its agents may use or permit use of in any and all media formats and may copyright for sale, advertising, publicity or for other business purpose the images or video taken on or about any event date in which Entrant performs and/or all such images and/or all such images and/or video become the property of American Drum Line Association (ADLA).

It is further understood and agreed that the Entrant irrevocably grants permission to use its name, likeness, photographic and any reproduction of their performance at any American Drum Line Association (ADLA) event for any advertising and/or educational purpose, and releases American Drum Line Association (ADLA) from all claims liabilities and/or damages which may arise from such use.

Entrant/ensemble/organization irrevocably grants permission to use their name, likeness, photographic and any reproduction of their performance and individuals at any American Drum Line Association (ADLA) event for any advertising and/or educational purpose, and releases American Drum Line Association (ADLA) from all claims, liabilities and/or damages which may arise from such use.

Non-Liability, Consent and Release.  Entrant acknowledges and agrees that American Drum Line Association (ADLA) and their respective employees, directors, officers, agents, staff and representatives shall not be responsible for any injuries sustained by any ensemble performing member, students, staff, directors. support personnel, student helpers, parents/legal guardians, guests of ensemble/entrant, volunteers or anyone else representing the entrant/ensemble or entrants/ensembles organization during or in conjunction with any American Drum Line Association (ADLA) event.

Furthermore, your ensemble and/or organization, including it’s sponsoring organization, hereby agree to indemnify, defend and hold harmless American Drum Line Association (ADLA) and their respective employees, officers, directors, agents, staff and representatives from any and all claims which might be brought by any person associated in any way with an event.  This includes, without limitation, claims that may be brought by ensemble performing members, students, staff, directors. support personnel, student helpers, parents/legal guardians, guests of ensemble/entrant, volunteers or anyone else representing the entrant/ensemble or entrants/ensembles organization in any way arising out of or during any performance of the entrant/ensemble at any event or in any way arising out of or connected with the attendance of said entrant/ensemble at any event.

This specifically includes, but is not limited to, any injuries sustained by ensemble performing members, students, staff, directors. support personnel, student helpers, parents/legal guardians, guests of ensemble/entrant, volunteers or anyone else representing the entrant/ensemble or entrants/ensembles organization caused by equipment used or moved by the ensemble, including but not limited to musical instruments and equipment, equipment/instrument trailers/haulers, props, flats, set decorations, scaffolds, ladders, chairs, or other similar equipment or devices.

Event Cancellation.  Entrant acknowledges that if an event is cancelled for any reason, Entrants sole recourse is a credit for event fees paid that may be used towards next season event registration fees.

Covenant Not to Sue.  In consideration of the rights granted hereunder and Entrant’s participation or involvement in any capacity at a American Drum Line Association (ADLA) event, Entrant on its own behalf and on behalf of its ensemble performing members, students, staff, directors. support personnel, student helpers, parents/legal guardians, guests of ensemble/entrant, volunteers or anyone else representing the entrant/ensemble or entrants/ensembles organization, representatives, successors, hereby releases, waives, discharges and covenants not to sue the American Drum Line Association (ADLA) for any claims, demands and liabilities for any and all damages, including without limitation, property damage, personal injury, or other responsibility asserted or adjudged against American Drum Line Association (ADLA) arising from Entrant’s participation or other involvement in an event, except any such claims, demands or liabilities asserted or adjudged against American Drum Line Association (ADLA) resulting solely from the gross negligence or willful misconduct of American Drum Line Association (ADLA).

Entrant further affirms all directors, instructors, coaches, consultants, clinicians, parents, volunteers, event workers, security, first aid, or school or district personnel associated in any way with the Entrants ensemble, school, or organization have completed all necessary background checks and training, accepts all responsibility for any and all claims, and agrees to indemnify and hold harmless ADLA from any claims arising from any incidents and or misconduct by any directors, instructors, coaches, consultants, clinicians, parents, volunteers, event workers, security, first aid, or school or district personnel associated in any way with the Entrants ensemble, school, or organization.  ADLA is not responsible for additional insurance requirements.

It is further understood and agreed that the Entrant accepts full liability for any act or omission by ensemble performing members, students, staff, directors. support personnel, student helpers, parents/legal guardians, guests of ensemble/entrant, volunteers or anyone else representing the entrant/ensemble or entrants/ensembles organization, representatives, or successors resulting in claims or damages at event sites, and further, that entrant will hold harmless American Drum Line Association (ADLA), its agents and employees from such claim or claims.

Other Items:

Choice of Law:  These Terms and Conditions shall be construed and enforced in accordance with the laws of the State of Nevada, without regard to conflicts of laws principles.

Forum:  Any action brought against American Drum Line Association (ADLA) shall be brought in the State of Nevada, Clark County.

Notices:  All notices under these Terms and Conditions, objections, demands, requests or other communications shall be in writing and shall be deemed effectively given upon personal delivery to American Drum Line Association (ADLA)/West Coast Winds Association (WCWA) or by certified mail, return receipt requested, postage prepaid and addressed as set forth above where payment is accepted.

No Waiver:  No waiver whether express or implied, of any breach of any term, condition, or obligation of these Terms and Conditions shall be construed as a waiver of any subsequent breach of that or any other term, condition, or obligation of the same or different nature, nor shall any delay or omission to exercise or avail any right, power or privilege that American Drum Line Association (ADLA) has or may have hereunder operate as a waiver of any breach or default.  No waiver shall be effective unless it is in writing and signed by an authorized Director of the ADLA.     

Survival:  If any of the provisions or portions of these Terms and Conditions are held to be invalid, illegal or unenforceable, they are to the minimum extent necessary deemed omitted, and the remaining provisions and portions thereof will be effective and enforceable.

By registering, Entrant certifies it has read. understands, acknowledges, and agrees to the above Terms and Conditions and that the person acting on behalf of Entrant is authorized to bind the entire ensemble, performing members, students, staff, directors. support personnel, student helpers, parents/legal guardians, guests of ensemble/entrant, volunteers or anyone else representing the entrant/ensemble or entrants/ensembles organization and further assumes responsibility to inform all of the entire ensemble, performing members, students, staff, directors. support personnel, student helpers, parents/legal guardians, guests of ensemble/entrant, volunteers or anyone else representing the entrant/ensemble or entrants/ensembles organization of the terms and provisions and ensure compliance.
